section 1542 waiver 이란?

일반 민사사건의 합의서에 section 1542 waiver 조항이 포함됨이 일반적이다.

Section 1542 of Civil Code:   "A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor."

민법 제1542 조는 일반 법적책임면제조항은  합의당시에 알려지지 않은 법률관계에는 적용되지 않음을 말한다.  즉 차후에 이러한 미지의 법률관계와 관련해서는 소송을 제기할 수 있다는 것으로 해석된다.   Section 1542 waiver 란 바로 이러한 차후의 소권에 대한 포기를 의미한다.
